Travail de Bruxelles (6e Ch.), N.R. 2020\/AB\/15).<\/p>\n\n<p>L&#8217;ex-employ\u00e9, actif dans l&#8217;industrie chimique, a saisi les Tribunaux pour contester le motif grave, mais ceux-ci lui ont donn\u00e9 tort, en premi\u00e8re et deuxi\u00e8me instance.<\/p>\n\n<p>L&#8217;employ\u00e9 avait publi\u00e9 sur son profil Facebook un ancien reportage faisant \u00e9tat d&#8217;une contamination du personnel (par des produits chimiques), au moment o\u00f9 l&#8217;on voulait vendre l&#8217;entreprise. Trois jours ouvrables apr\u00e8s le post &#8220;diffamatoire&#8221;, le contrat de travail a \u00e9t\u00e9 r\u00e9sili\u00e9 par l&#8217;employeur pour &#8220;motif grave&#8221;. L&#8217;employ\u00e9 aurait pr\u00e9tendu qu&#8217;il s&#8217;agissait d&#8217;une erreur, d&#8217;une &#8220;b\u00eatise&#8221;, mais l&#8217;employeur y a vu une intention claire de porter atteinte \u00e0 son image, d&#8217;autant plus que tous les employ\u00e9s avaient \u00e9t\u00e9 inform\u00e9s la veille de la publication Facebook que l&#8217;entreprise \u00e9tait reprise par un acqu\u00e9reur su\u00e9dois<\/p>\n\n<p>Dans ce contexte, l&#8217;employeur a estim\u00e9, \u00e0 juste titre, qu&#8217;un tel comportement rendait toute collaboration d\u00e9finitivement et imm\u00e9diatement impossible, m\u00eame si la publication en question avait, \u00e0 peine \u00e9t\u00e9 partag\u00e9e et \u00ab lik\u00e9 \u00bb. La publication pr\u00e9judiciable a donc apparemment fait peu de bruit, ce qui, selon la Cour du travail de Bruxelles, n&#8217;enl\u00e8ve rien au potentiel nuisible du message. En effet, une telle action aurait pu dissuader l&#8217;acqu\u00e9reur et\/ou, dans le pire des cas, emp\u00eacher la reprise.<\/p>\n\n<p>Le fait que le profil Facebook de l&#8217;employ\u00e9 en question n&#8217;\u00e9tait pas public (mais priv\u00e9) n&#8217;est pas non plus pertinent.
